S.W. Bell Mobile Systems, Inc. v. Franco
August 21, 1997, Texas Appellate Court Corpus Christi: Plaintiffs prevailed in obtaining emotional distress damages after complaining of sexual harassment in the workplace and being terminated. The suit was brought by former employees against their employer for retaliatory termination and intentional infliction of emotional distress. The court held that the employer violated the Texas Commission on Human Rights Act by terminating the plaintiffs. The court held that the plaintiff's evidence and testimony was sufficient to support a finding that the employer engaged in extreme and outrageous conduct for purposes of the plaintiffs' claim of intentional infliction of emotional distress.
